III. The Security Assurances Contained in the Budapest Memorandum The Budapest Memorandum was signed by Ukraine, Russia, the United States, and the United Kingdom. China and France subsequently issued separate statements providing similar assurances. The key distinction is that the memorandum provided political security assurances, rather than legally binding military security guarantees comparable to the collective-defense commitments of a formal military alliance. Its principal commitments included the following: Respect for Ukraine’s independence, sovereignty, and existing borders. Refraining from the threat or use of force against Ukraine, except in self-defense or otherwise in accordance with the United Nations Charter. Refraining from economic coercion intended to subordinate Ukraine’s sovereign rights to another country’s interests. Seeking immediate action by the United Nations Security Council if Ukraine became the victim of an act of aggression, or the threat of aggression, involving nuclear weapons. Refraining from the use of nuclear weapons against Ukraine as a non-nuclear-weapon state, subject to the memorandum’s stated exceptions. Consulting with one another if questions arose concerning these commitments. Important Legal and Political Distinctions The Budapest Memorandum was a political document. It was not ratified by the U.S. Senate as a treaty, and it did not establish a legally enforceable collective-defense mechanism or impose an explicit obligation on the United States or the United Kingdom to intervene militarily if Ukraine were attacked. U.S. officials at the time made clear that the memorandum did not constitute a new military defense commitment or a guarantee that the United States would go to war to defend Ukraine. Nevertheless, the memorandum contained explicit commitments concerning Ukraine’s sovereignty, territorial integrity, and security. Russia’s subsequent actions against Ukraine fundamentally undermined the credibility of those commitments. ⸻ IV. Russia’s Subsequent Aggression Against Ukraine: Causes and Consequences Major Events 2014: Russia’s Annexation of Crimea Russia annexed Crimea and supported separatist forces in the Donbas region of eastern Ukraine, triggering a prolonged armed conflict. These actions were widely regarded as a clear violation of the Budapest Memorandum and its commitments to respect Ukraine’s sovereignty and existing borders. February 24, 2022: Russia’s Full-Scale Invasion of Ukraine Russia launched a full-scale military invasion of Ukraine, dramatically escalating the conflict and triggering the largest war in Europe in decades. The war has continued into 2026.
