Interesting take from Hyperliquid co-founder Jeff Yan 🗣️: regulatory compliance responsibility should fall on front-end market operators, not the underlying L1, which means Hyperliquid shouldn't be classified as a registered US exchange just because trades settle on its L1. We’ve got HIP-3 that lets external teams launch perpetual markets on Hyperliquid (you need to stake 500k HYPE and keep it for 183 days) and Permissioned Markets for whitelisting access, but that doesn’t check all US regulatory boxes yet. Payward is looking to launch US-facing on-chain perps starting from HIP-3 markets with functions split between DCM and FCM entities, but it still needs regulatory approval, and the new CFTC framework isn’t even final yet—comment period closes Dec 14 📅.
